CONFEDERATION PUBLISHES DRAFT REPLY TO 7 TH PAY COMMISSION QUESTIONNAIRE

DRAFT REPLY TO 7TH CENTRAL PAY COMMISSION QUESTIONNAIRE - SUGGESTION, ADDITION AND ALTERATION, IF ANY, CALLED FOR.

Dear Comrade,

            We place hereunder the draft reply to the questionnaire issued by the 7th CPC.  We want you to go through the same and make suggestions to enrich it further.  We propose to place the same at the staff side meeting of the National Council on 6th May, 2014.  The final version as formulated by the Staff Side will also be published on7th May. 2014.  We have to arrive at a consensus taking into account all shades of opinions.
            The replies are drafted to make it as brief as possible.  It covers only common issues. The staff side National Council will be submitting a detailed memorandum later as and when it is called for by the 7th CPC.  The said memorandum will be drafted taking into account the views of all organizations including pensioners organisations. Department specific issues are to be covered by the memorandum submitted by the respective departmental organizations.  Since there will be very short time available for submission of memorandum, in view of the overall time frame of 18 months  all affiliates are requested to finalize their approach and prepare the memorandum and keep it ready for submission without loss of time.
            It will be our endeavor that on common issues, complete unanimity of opinion emerges amongst all Federations of Central Govt. employees.

Dear Comrades,

Campaign Week

All the Units might be, by this time, in thick of preparation for Campaign Week. We should ensure that the campaign takes the demands finalised by the Shimla CWC to all personnel working in IA&AD, irrespective of cadre and office. Every campaign, agitation is a step forward in strengthening the bond with the membership and to raise the conscious level of the membership on the charter of demands. All out effort to reach out to those who are away from our organisation in all offices  shall have to be the approach.

JAC calls for Signature Campaign

As informed during Shimla CWC, the JAC has called upon every Audit & Accounts employee to go for a massive signature Campaign on the demands. The JAC Circular and the draft for signature campaign is given along with this Circular.

Synchronise Campaign Week and Signature Campaign

The signature campaign on the demands on pay scale etc may be taken up during the campaign week. All the Units may complete the signature campaign by 31st May 2014 and send it to HQr.

Send Report

All the Units are requested to send detailed reports on how the Campaign Week was observed and status of signature campaign. The report may be sent on the closing hours of 2nd May itself.

Observe May Day

1st May is the International Day of Workers. We are remembering the great sacrifices of those workers of Chicago including the three who went to the gallows who made “the 8 hour work, 8 hour recreation and 8 hour rest” the slogan of the workers world over.

This May Day has significance for India. The people, vast majority of whom are struggling to meet both the ends meet, is on the way to polling booths to elect the rulers for the next five years. The print and electronic media tries to make the fight between two individuals. But for the common man in India, it is much more than that. This election would decide how they would be living in the coming five years, what would be  the intensity of the depravation that would have to face – unless and until the worker, the down trodden identifies its real friends and vote decisively for a change in the policy direction that would be people friendly, worker friendly.

All our Units may observe May Day – jointly with other trade unions of the station – joining the mass processions and meetings.

The apex JAC met on 9th April, 2014 to review the programme of Joint Dharna on 26th March 2014. Com. S. K. Vyas, Adviser, Confederation of Central Government Employees and Workers’, Com. V. Bhattacharjee, Convener, Apex JAC and Secretary General National Federation of Civil Accounts Associations, Com. T.        Satyanarayana, General Secretary, All India Postal Accounts Employees Association, Com. A. K. Mehta, President, All India Civil Accounts Employees Association Category-II and Com. S.S. Chauhan, President, All India Association of Pay and Accounts Officers(Civil)alongwith Shri R. K. Gupta, Joint Secretary General of His organization attended the meeting. Com. M. S. Raja, Chairman, apex JAC and Secretary General All India Audit and Accounts Association could not attend the meeting due to ill health. 
Com.T. Satyanarayana, General Secretary, All India Postal Accounts Employees Association presided over the meeting. It was observed that, the programme of joint Dharna by local JACs on 26th March 2014 has been observed widely at several places. The meeting felt that there is a need to educate the mass of employees about the demands which the apex level JAC has adopted so that in future total participation of the members could be ensured in the programmes. Since the common demands of Stenographers/PAs/Sr.PAs are not there in the charter of demands, it has been decided to incorporate the same and constituents of apex JAC has been requested to send their proposals in this respect. As regards DEOs the situation in different constituents being different, it was decided at the very initial stage that, the demands of this cadre shall be dealt by the constituents departmentally. With this object in view, the meeting has decided that the “signature Campaign” may be launched during the month of April & May 2014 on a brief memorandum listing all the demands and with a request that these demands should be settled at the earliest.
The memorandum is annexed to this circular. Signatures may be obtained in this memorandum in duplicate. One copy may be sent to the Prime Minister and another copy may be forwarded to the headquarters of apex JAC under intimation to headquarters of respective All India Associations. The signatures will be taken by local units under overall co-ordination of local JACs and each and every member may be approached individually for signature. It should be ensured that all the members sign it latest by 31st May 2014.
The apex JAC will finalise a tour programme during the months April, May & June 2014 in consultation with the Chief Executives of constituents of apex JAC  so that local JACs are revitalised and start functioning.

3. Implementation of Arbitration Awards
            It has been decided in the meeting of the National Anomaly Committee that these demands may be discussed by Joint Secretary, Estt (DOPT) and Joint Secretary, Personnel (Department of Expenditure).  Twice the Joint Secretary, Personnel has informally met the members of the staff side.  last meeting was held on 14.02.2014. But this Sub-committee consisting of Joint Secretary, Personnel is yet to have first formal meeting to discuss these demands and to settle them.
            We therefore, request you to direct these officers to have early discussion with the staff side members with a view to settle these demands without further delay.

OBSERVE CAMPAIGN WEEK: 28 APRIL – 2nd MAY 2014

Dear Comrades,

The Shimla CWC decided to organise a series of mobilisation programmes followed by agitational programmes in pursuance of the Charter of Demands adopted by the CWC. The first phase of the programme is Campaign Week from 28th April to 2nd May 2014.

During the Campaign Week, all out effort to publicise the   Charter of Demands should be undertaken. This should be done by circulating the charter of demands amongst the mass of employees and through extensive postering on each item in the Charter of Demands. It advisable that the charter of demands are presented to employees in the local language.

            A brief outline on how we should go ahead with campaign week is given below:

            28th April – circulate the charter of demands in full to the entirety of employees

            29th April – Postering on first 6 items on charter may be done

            30th April – Postering on items 7, 8 & 9 may be done

1st May –  Propagate the message of May Day and the tasks ahead; also postering on items 10-15 may be done.

2nd May  -  Postering on items 16-22 may be done.

The Units may make its own modification to the above given format – it is only indicative format. The Charter of Demands adopted by the Shimla CWC is given along with this Circular. The idea is to put across the charter of demands to the membership and to get them rallied under these demands. Units may decide how best, effectively this could be done. Charter of Demands is given along with this circular.

Each Unit may please ensure that the Campaign Week is observed with all vigour and involvement of the entire Executive committee and activists.

            A detailed Report on the observance of the Campaign week may be sent to HQr on 2nd May itself – through email, followed by hard copy by post.

CHARTER OF DEMANDS

         1. i) Merge Auditor/Accountant with Senior Auditor/Accountant and grant the GP    of 4600 in PB2
             ii)  Grant the GP of 5400 in PB 2 to AAOs, GP of 6600 in PB 3 to AOs and 7600 to SAOs in PB 4
             iii) Revive the cadre of Record Keeper by de-merging from MTS and grant GP 1900 in PB 1.

        Stop down-sizing; Stop outsourcing & privatisation of Audit & Accounts; Scrap              Curtailment/shedding of Audit functions in the name of Audit Plan; ensure  continuance of the existing Accounting and Auditing methodologies and appropriate party days with scientific work norms; ensure effective Panchayati Raj Audit & Accounts by sanctioning adequate posts; revisit restructuring of Audit effected from 1..4. 2012.

         9.  a) Amend Company Law and DPC Act for Audit of Public Sector Undertakings &  Corporations even after reduction of Government share to below 50%.
    b) Amend Company Law to ensure the Audit by IA&AD of all Public Limited   Companies listed with Securities and Exchange Board of India (SEBI)
     c) Enact necessary law to bring audit of all public Financial Institutions by IA&AD.           

 10.   a)  Vacate victimisation of Association activists.

7th CPC Questionnaire 

 

1. Salaries 

 

1.1 The considerations on which the minimum salary in case of the lowest Group ‘C’ 

functionary and the maximum salary in case of a S ecretary level officer may be 

determined and what should be the reasonable ratio between the two. 

 

1.2 What should be the considerations for determining salary for various levels of 

functions falling between the highest level and the lowest level functionaries? 

 

2. Comparisons 

 

2.1 Should there be any comparison/parity between pay scales and perquisites 

between Government and the private sector? If so, why? If not, why not? 

 

2.2 Should there at all be any comparison/parity between pay scales and perquisites 

between Government and the public sector? If so, why? If not, why not? 

 

2.3 The concept of variable pay has been introduced in Central Public Sector 

Enterprises by the Second Pay Revision Committee. In the case of the Government is 

there merit in introducing a variable component of pay? Can such variable pay be linked 

to performance? 

 

3. Attracting Talent 

 

3.1 Does the present compensation package attract suitable talent in the All India 

Services & Group A Services? What are your observations and suggestions in this 

regard? 

 

3.2 To what extent should government compensation be structured to attract special 

talent? 

 

4. Pay Scales 

 

4.1 The 6th Central Pay Commission introduced the system of Pay Bands and Grade 

Pay as against the system of specific pay scales attached to various posts. What has been 

the impact of running pay bands post implementation of 6th CPC recommendations? 

 

4.2 Is there any need to bring about any change? 

 

4.3 Did the pay bands recommended by the Sixth CPC help in arresting exodus and 

attract talent towards the Government? 

  

 

 

 

4.4 Successive Pay Commissions have reduced the number of pay scales by merging 

one or two pay scales together. Is there a case for the number of pay scales/ pay band to 

be rationalized and if so in what manner? 

 

4.5 Is the “grade pay” concept working? If not, what are your alternative 

suggestions? 

 

5. Increment 

 

5.1 Whether the present system of annual increment on 1 st

 July of every year 

uniformly in case of all employees has served its purpose or not? Whether any changes 

are required? 

 

5.2 What should be the reasonable quantum of annual increment? 

 

5.3 Whether there should be a provision of variable increments at a rate higher than 

the normal annual increment in case of high achievers? If so, what should be transparent 

and objective parameters to assess high achievement, which could be uniformly applied 

across Central Government? 

 

5.4 Under the MACP scheme three financial up-gradations are allowed on completion 

of 10, 20, 30 years of regular service, counted from the direct entry grade. What are the 

strengths and weaknesses of the scheme? Is there a p erception that a s cheme of this 

nature, in some Departments, actually incentivizes people who do not wish to take the 

more arduous route of qualifying departmental examinations/ or those obtaining 

professional degrees? 

 

6. Performance 

 

What kind of incentives would you suggest to recognize and reward good 

performance? 

 

7. Impact on other organizations 

 

Salary structures in the Central and State Governments are broadly similar. The 

recommendations of the Pay Commission are likely to lead to similar demands from 

employees of State Governments, municipal bodies, panchayati raj institutions & 

autonomous institutions. To what extent should their paying capacity be considered in 

devising a reasonable remuneration package for Central Govt. employees? 

 

8. Defence Forces 

 

8.1 What should be the considerations for fixing salary in case of Defence personnel 

and in what manner does the parity with civil services need to be evolved, keeping in 

view their respective job profiles? 

  

 

 

8.2 In what manner should the concessions and facilities, both in cash and kind, be 

taken into account for determining salary structure in case of Defence Forces personnel. 

 

8.3 As per the November 2008 orders of the Ministry of Defence, there are a total of 

45 types of allowances for Personnel Below Officer Rank and 39 types of allowances for 

Officers. Does a case exist for rationalization/ streamlining of the current variety of 

allowances? 

 

8.4 What are the options available for addressing the increasing expenditure on 

defence pensions? 

 

8.5 As a measure of special recognition, is there a case to review the present benefits 

provided to war widows? 

 

8.6 As a measure of special recognition, is there a case to review the present benefits 

provided to disabled soldiers, commensurate to the nature of their disability? 

 

9. Allowances 

 

9.1 Whether the existing allowances need to be retained or rationalized in such a 

manner as to ensure that salary structure takes care not only of the job profile but the 

situational factors as well, so that the number of allowances could be at a realistic level? 

 

9.2 What should be the principles to determine payment of House Rent Allowance? 

 

10. Pension 

 

10.1 The retirement benefits of all Central Government employees appointed on or 

after 1.1.2004 a re covered by the New Pension Scheme (NPS). What has been the 

experience of the NPS in the last decade? 

 

10.2 As far as pre-1.1.2004 appointees are concerned, what should be the principles 

that govern the structure of pension and other retirement benefits? 

 

11. Strengthening the public governance system 

 

11.1 The 6th CPC recommended upgrading the skills of the Group D employees and 

placing them in Group C over a period of time. What has been the experience in this 

regard? 

 

11.2 In what way can Central Government organizations functioning be improved to 

make them more efficient, accountable and responsible? Please give specific suggestions 

with respect to: 

 

 a) Rationalisation of staff strength and more productive deployment of available 

staff;  

 

 

 

b) Rationalisation of processes and reduction of paper work; and 

c) Economy in expenditure. 

 

12. Training/ building competence 

 

12.1 How would you interpret the concept of “competency based framework”? 

 

12.2 One of the terms of reference suggests that the Commission recommend 

appropriate training and capacity building through a competency based framework. 

 

a) Is the present level of training at various stages of a person's career considered 

adequate? Are there gaps that need to be filled, and if so, where? 

b) Should it be made compulsory that each civil service officer should in his career 

span acquire a professional qualification? If so, can the nature of the study, time 

intervals and the Institution(s) whose qualification are acceptable, all be 

stipulated? 

c) What other indicators can best measure training and capacity building for 

personnel in your organization? Please suggest ways through which capacity 

building can be further strengthened? 

 

13. Outsourcing 

 

13.1 What has been the experience of outsourcing at various levels of Government and 

is there a case for streamlining it? 

 

13.2 Is there a clear identification of jobs that can be outsourced? 

 

14. Regulatory Bodies 

 

14.1 Kindly list out the Regulators set up unde r Acts of Parliament, related to your 

Ministry/ Department. The total number of personnel on rolls (Chairperson and members 

+ support personnel) may be indicated. 

 

14.2 Regulators that may not qualify in terms of being set up under Acts of Parliament 

but perform regulatory functions may also be listed. The scale of pay for Chairperson 

/Members and other personnel of such bodies may be indicated. 

 

14.3 Across the Government there are a host of Regulatory bodies set up for various 

purposes. What are your suggestions regarding emoluments structure for Regulatory 

bodies? 

 

15. Payment of Bonus 

 

One of the terms of reference of the 7th Pay Commission is to examine the 

existing schemes of payment of bonus. What are your suggestions and observations in 

this regard?
